Terms and Conditions for Inland Dynamic Enterprises

​These Terms and Conditions ("Agreement") govern the use of our website, the purchase, rental, and servicing of heavy-duty equipment from Inland Dynamic Enterprises, and all other services provided by us. By accessing our website or engaging with our products and services, you agree to abide by these Terms and Conditions.

By using our services, purchasing products, or accessing our website, you agree to these Terms and Conditions, as well as any additional terms or policies provided by Inland Dynamic Enterprises.

1.2. Eligibility
You must be at least 18 years old and capable of entering into a legally binding contract in order to purchase, lease, or rent heavy-duty equipment from us.

2. Product Information

2.1. Accuracy of Information
We strive to ensure that all product descriptions, prices, and availability listed on our website or provided to you are accurate. However, we do not guarantee that all information is error-free and may update or correct information at any time.

2.2. Pricing and Availability
Prices for products and services are subject to change without notice. Availability of products and services may vary and may be limited. We reserve the right to modify or discontinue any products or services at any time.

 

3. Orders and Payment

3.1. Placing an Order
When you place an order with us, you are making an offer to purchase or rent heavy-duty equipment or related services. All orders are subject to acceptance by Inland Dynamic Enterprises.

3.2. Payment
Payment for products, services, and equipment rentals must be made in full at the time of order, unless otherwise agreed upon. We accept various forms of payment, including credit/debit cards, financing, and other methods, as specified at checkout.

3.3. Financing
If you are financing a purchase through one of our partners, your application and approval will be subject to the terms and conditions set forth by the financing provider. We do not guarantee approval of financing and are not responsible for decisions made by third-party financing companies.

3.4. Deposit Requirements
For certain equipment orders or rentals, a deposit may be required at the time of agreement. The deposit amount will be specified in the purchase agreement or rental contract.

 

4. Shipping, Delivery, and Pickup

4.1. Shipping
For sales of products, we will arrange for delivery to the address specified in your order. Shipping fees and delivery times may vary depending on the location, size, and type of equipment ordered.

4.2. Delivery/Shipping Risks
Once the equipment has been shipped or delivered, risk of damage or loss passes to the customer. It is your responsibility to inspect equipment upon delivery and notify us of any damages or discrepancies within [insert number of days, e.g., 7 days].

4.3. Rental Pickup and Delivery
For rental equipment, we may provide delivery and pickup services. You are responsible for the equipment during the rental period and must return it in the same condition it was received, subject to reasonable wear and tear.

 

5. Equipment Use and Maintenance

 

5.1. Use of Equipment
You agree to use the purchased or rented equipment only for its intended purpose and in accordance with the manufacturer's guidelines and safety instructions. You are responsible for any damages caused by misuse or negligence.

5.2. Maintenance and Repairs
For purchased equipment, you are responsible for routine maintenance as outlined in the product manual. For rental equipment, we provide regular maintenance as needed, but you must notify us promptly if any issues arise.

5.3. Warranty
New equipment may come with a manufacturer's warranty, which covers defects in materials and workmanship for a specified period. The terms of the warranty will be provided with your purchase. Warranty from Inland Dynamic Enterprises varies on commercial equipment.

 

6. Returns and Cancellations

6.1. Returns
Returns of purchased products are subject to approval and must be made within 3 days from the date of purchase. The product must be in new, unused condition with all original packaging and accessories. Certain products may not be eligible for return, including custom-ordered or special-order items.

6.2. Cancellations
Cancellations of orders must be made within 24 hours after placing the order. Orders that have already been shipped or processed may not be eligible for cancellation. Rental agreements may be canceled or modified based on the terms outlined in the rental contract.

 

7. Limitation of Liability

7.1. No Liability for Indirect Damages
To the fullest extent permitted by law, Inland Dynamic Enterprises is not liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the sale, rental, use, or performance of equipment, including but not limited to loss of profit, business interruption, or equipment downtime.

7.2. Maximum Liability

In no event shall Inland Dynamic Enterprise's total liability exceed the amount paid for the equipment or service giving rise to the claim.

 

8. Indemnification

You agree to indemnify, defend, and hold harmless Inland Dynamic Enterprises, its affiliates, and its employees from any claims, damages, liabilities, and expenses arising from your use or misuse of our equipment or services, your violation of these Terms and Conditions, or your infringement of any rights of another party.

 

9. Privacy and Data Protection

Your use of our services is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our services, you consent to the collection and processing of your personal data in accordance with our Privacy Policy.

 

10. Governing Law and Dispute Resolution

10.1. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the state of California, without regard to its conflict of law principles.

 

10.2. Dispute Resolution
Any disputes arising from these Terms and Conditions will be resolved through binding arbitration, rather than in court, in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in San Bernardino County, and judgment on the award may be entered in any court having jurisdiction.
